Abstrak

ABSTRACT: Legal issues are not just issue a law just because the laws have always associated with norms how someone was supposed to do or not do anything illegal, violating the law is not equal to violate moral, so that the meaning of existing law in positive law is not enough without being associated with a moral which is the 'spirit' of law so that law without “spririt” is vain. Therefore also different punishment given specially about a naughty child who can still be nurtured back to be a good boy in the criminal must not punisment, remind the principle of criminal law as an ultimum remedium ABSTRAK:
